====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 23-11-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 406 and 409 of the Indian Penal Code.

The petitioners are In-charge Headmaster and Secretary of the School, Education Committee. Allegation is that they withdrew Rs.72,291/- from the account of the school for construction of the school building. However, the construction was still incomplete and the petitioners misappropriated the same. The petitioners have stated on oath that they have got no criminal antecedent as well as the impugned order reveals that the said amount has already been deposited in the bank account.

No.50570 of 2016 (2) dt.23-11-2016 2/2 In the facts and circumstances of the case, let, the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate1st Class, Jhanjharpur, Madhubani/Successor Court in connection with Rudrapur P.S. Case No. 32 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
