Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Barhat P.S. Case No. 52 of 2019, registered under Sections 143, 147, 149, 117, 342, 353, 504 and 506 of the Indian Penal Code.
The accusation is that on receiving information about stopping the bus at Bakhari Chouck, the informant along with other police personnel reached there then saw that mob of

No.34742 of 2020(2) dt.23-03-2021 2/3 50 to 60 persons were indulged in blocking the road by parking the Pickup Van on N.H.333 and at a distance of 100 yards, one bus was also parked. On query, informant and other police personnel came to know that with regard to boarding of passengers in the Tempo and Bus, staff of Sisocia Bus Travel has assaulted to Tempo driver. Thereafter, informant asked to furnish the written complaint and tried to pacify the matter but the mob started to scuffle and creating nuisance in discharge the official duty. Thereafter, informant and other police personnel informed to Barhat Police Station then police party came there but in spite of that they did not spot creating nuisance. The mob was leaded by 16 persons named in the FIR including the petitioner.
Learned counsel for the petitioner submits that while petitioner is named in the FIR but no specific overt act has been attributed against the petitioner. Further submission is that petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like
Patna High Court CR. MISC. No.34742 of 2020(2) dt.23-03-2021 3/3 amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Jamui, in connection with Barhat P.S. Case No. 52 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
