JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 01-07-2019 It is the case of the petitioner that pursuant to the short term tender notice no.05/2018-19 for settlement of Sairat for the financial year 2019-20 issued on 07.03.2019, the petitioner participated in the same and he has deposited Rs.5,44,500/-. On 27.03.2019, the petitioner claims to have been selected being the highest bidder among the other three participants and in terms of the advertisement the petitioner has deposited Rs.21,86,000/- as half amount of the bid amount of Rs.54,61,000/- in the name of the Nagar Panchayat, Bodh-Gaya, but according to the petitioner till date the parwana has not been issued in favour of the petitioner. Patna High Court CWJC No.8529 of 2019(2) dt.01-07-2019 2/2 dated 03.04.2019 has been filed before the Executive Officer, Nagar Panchayat, Bodh-Gaya, as contained in Annexure-4 to the writ application, but the same has not been considered. It is thus his grievance that on the one hand the petitioner has been selected and he has deposited the substantial amount, at the same time the agreement is not being executed and parwana has not been issued which is causing monetary loss to the petitioner. Learned counsel for the State as well as Nagar Panchayat, Bodh Gaya are present.

In the nature of the grievance raised by the petitioner, this Court directs the Executive Officer, Nagar Panchayat, Bodh-Gaya (respondent no.5) to look into the grievance of the petitioner as contained in Annexure-4 to the writ application and take an appropriate decision thereon within fifteen days from the date of receipt/production of a copy of this order. It would be incumbent upon him to examine the entire matter and take an appropriate action as he deems just and proper and in accordance with law.
