JUSTICE AJAY KUMAR TRIPATHI ORAL ORDER 06-07-2017 The District Programme Officer (Establishment) is given freedom to verify the authenticity of the reason for delay offered by the Headmaster, who is the drawing and disbursing officer.
If the plea put up for non-release and delay for almost two years caused therein is not found satisfactory, the interest component, which is being now paid to the petitioner for delay by the State, will be recovered from the Headmaster of the school in question after giving him an opportunity of hearing. Counsel for the State assures this Court that
Patna High Court CWJC No.14034 of 2015 (3) dt.06-07-2017 2/2 statutory interest up till the date of payment will be released in favour of the petitioner sooner than later. The main component of payment has already been paid as it emerges from the affidavit and the evidence on record.
This writ application stands disposed of.
