Mr.Anish Chandra ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 27-07-2023 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 147, 148, 149, 323, 307, 337, 338, 504, 506/302 of the Indian Penal Code.

3. Learned counsel for the petitioners fairly submits that the petitioners are the absconder and trial of the petitioners were separated from the other accused persons in which witnesses have supported the prosecution case. He further submits that petitioners have no criminal antecedent as stated in para-3 of this application.

4. Learned APP for the State opposes the prayer

Patna High Court CR. MISC. No.35214 of 2023(2) dt.27-07-2023 2/2 for bail.

5. Considering the nature of offence, I am not inclined to enlarge the petitioners on bail. Accordingly, prayer for anticipatory bail is rejected in connection with Bath P.S. Case No. 12 of 2020.

6. However, if the petitioners surrender before the learned court below within a period of six weeks from today and pray for regular bail, the same shall be considered by the learned court below on the same day without being prejudiced by this order.
