This application for anticipatory bail arises out of Patory (Mohanpur O.P.) Police Station Case No. 20 of 2019 for the offence punishable under Sections 341/447/323/324/307/379/504/34 of the Indian Penal Code. It appears from the First Information Report that an altercation in the family and intervention of other members into the dispute, led to certain occurrence. There is allegation against the petitioner, who is a neighbour and who is said to have intervened, is of assaulting the informant with sharp-edged weapon (Garasa).
Learned Counsel for the petitioner has submitted that the injury has been found to have been caused by hard and
Patna High Court CR. MISC. No.26026 of 2019(2) dt.22-04-2019 2/2 blunt substance, which falsifies the nature of accusation. Considering the above submission, this application is allowed.
Let the petitioner Mithilesh Pandit, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, IV, Samastipur, in Patory (Mohanpur O.P.) Police Station Case No. 20 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
