2. The petitioner apprehends his arrest in a case registered for the offence under Section 394 of the Indian Penal Code.

3. It is alleged that four unknown miscreants, riding on motorcycle, assaulted the informant and on the point of pistol, got transferred all the money from the account of informant through Phone Pay App.

4. Name of the petitioner transpired during course of investigation in the confessional statement of co-accused Amit Kumar and Aditya Raj. No incriminating article has been recovered from the possession of this petitioner. Petitioner has got no criminal antecedent.

5. However, learned A.P.P. for the State vehemently

Patna High Court CR. MISC. No.29218 of 2023(4) dt.18-08-2023 2/2 opposes the prayer for anticipatory bail and submits that during course of investigation, ample evidence has come against this petitioner. In paragraph - 30 of the case diary, it has come that this petitioner is main catalyst of whole incident and the SIM, which he was using in the crime, is in the name of brother of coaccused Amit Kumar.

6. Considering the aforesaid facts and circumstances, the prayer for anticipatory bail of petitioner is rejected. (Prabhat Kumar Singh, J) anay/- U T
