The petitioner is in judicial custody in connection with Lauriya P.S. Case No.165 of 2021 instituted under Sections 302,328,307/34 of the Indian Penal Code, 1860 and Section 30(a), 33, 37(b) of Bihar Prohibition and Excise Act, 2016 lodged on 17.07.2021 by the informant Rashid Shah. As per the allegation in the FIR, this petitioner along with Suresh Sah, Rambriksh Choudhary, Ajay Choudhary, Amresh Ram and Bhadar Sah with Suresh Badhai used to sell country made liquor.

Earlier the petition was rejected on 29.08.2022 but without waiting for the cooling of period, the petitioner preferred bail application before the Sessions Court, West Champaran, Bettiah which came to be rejected on 16.03.2023. Considering the allegation against the petitioner, for

Patna High Court CR. MISC. No.29062 of 2023(2) dt.03-05-2023 2/2 the present, this Court is not inclined to extend him privilege of bail, which is accordingly rejected.
