2. The petitioner apprehends his arrest in connection with Piprahi P.S. Case No. 240 of 2023 registered under Sections 341, 323, 324, 307, 325 and 34 of the Indian Penal Code.
3. As per prosecution case, the allegation against this petitioner is of assaulting the informant and one Ashutosh Kumar with knife on their head and neck, on account of which, they sustained injuries.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to land dispute. Further submission is that there is case and counter case between the
Patna High Court CR. MISC. No.31638 of 2024(2) dt.22-05-2024 2/2 parties. The injuries allegedly caused by this petitioner is simple in nature. It is next submitted that both the parties have compromised the present case, as contained in Annexure-4 to the bail petition. The petitioner has got no criminal antecedent.
5. Having considered the fact that both the parties have compromised the present case and the nature of injury, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate-I, Sheohar in connection with Piprahi P.S. Case No. 240 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Singh, J) utkarsh/- U T
