The petitioners seek bail in anticipation of their arrest in connection with Arwal P.S. Case No. 105 of 2018 dated 12.04.2018 instituted for the offences under Sections 467, 468, 471, 420 and 120(B) of the Indian Penal Code.

The petitioners are villagers and are members of the concerned PACS who are alleged to have falsely represented about there being owners of bigger plots of land. Because of such false representation by the PACS president as also the petitioners, more quantity of paddy than what was given ought to have been given to the aforesaid PACS.

Patna High Court Cr.Misc. No.33452 of 2018(3) dt.03-07-2018 2/2 Learned counsel for the petitioner has submitted that some of the accused persons of this case have been granted anticipatory bail. He further submits that there is no allegation of the petitioners having shown larger plots of land in their possession. Whatever was represented and which was ultimately found to be wrong was by one Sanjay Kumar and not the petitioners. The petitioners are poor farmers who are barely able to make their two ends meet.

Considering the aforesaid facts, the petitioners above named are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal in connection with Arwal P.S. Case No. 105 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
