Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in connection with Rampur P.S. Case No.123 of 2020, registered for the offence punishable under Sections 147/148/149/341/323 /307 / 379/504 of the Indian Penal Code.

In the background of land dispute between the parties allegation is that petitioner caused injury at the head of the informant. The doctor has found lacerated wound caused by hard and blunt substance simple in nature at the occipital region

Patna High Court CR. MISC. No.28286 of 2020(2) dt.07-12-2020 2/2 measuring 3 cm x 2 cm x 1 cm.

Since the petitioner had knowledge that his act might cause death, I am not inclined to grant anticipatory bail to the petitioner. Hence, the prayer for anticipatory bail is refused. However, in the event of surrender of the petitioner, the prayer for regular bail shall be considered without being prejudiced by the order of this Court.
