2. The petitioner seeks bail in a case registered for the offence punishable under Sections 420, 465, 467, 468, 471, 120-B of the I.P.C., 1860.

3. As per the prosecution case, the complainant alleges that after purchasing land from one Md. Shahadat, the accused fraudulently resold the same land to another party in 2015.

4. Learned counsel for the petitioner submits that the present case arises out of a complaint and the allegation relates to fraudulent execution of sale deed by one Md. Shahadat who sold the said land to one Debu Sah. So far as the role of the petitioner is concerned, the same is confined to being an identifier on the said sale deed. It has further been submitted that there is a delay of five

No.27954 of 2026(3) dt.10-06-2026 2/2 days in lodging of the complaint and the dispute is purely civil in nature and as such the other avenues of civil remedy is always open. The petitioner is an old man aged about 80 years with clean antecedent and he is in custody since 18.02.2026.

5. Learned APP for the State and learned counsel for the complainant have strongly opposed the prayer for grant of bail of the petitioner.

Taking into consideration the facts and circumstances of the case and also considering the fact that the present complaint case involves private dispute regarding sale deed and the role of the petitioner is only that of identifier thereon, coupled with the fact that he is an old and ailing man with clean antecedent, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Saharsa/concerned Court below in connection with Complaint Case No. 3652 of 2015.
