The petitioner apprehends his arrest in Phulwarisharif P.S. Case No. 376 of 2015 instituted for the offence under Sections 143, 341, 323, 354, 504/34 of Indian Penal Code.
It is alleged that name of this petitioner has come in the confessional statement of co-accused Arun Kumar @ Sanichar who has been identified by the villagers.
It has been submitted on behalf of the petitioner that co-accused Bichhua Paswan with similar allegation has been granted anticipatory bail by learned Addl. Sessions Judge-II, Patna vide ABP No. 3660 of 2015 order dated 27.08.2015 but the same
Patna High Court Cr.Misc. No.84 of 2017 (2) dt.10-01-2017 2/2 court has rejected the anticipatory bail petition of this petitioner. This court failed to understand the reason for passing different order with respect to this petitioner. Allegation against this petitioner is also same and similar.
Be that as it may, in the facts that petitioner's name has come in the confessional statement of co-accused Arun Kumar @ Sanichar, in the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Phulwarisharif P.S. Case No. 376 of 2015, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Patna, subject to the conditions as laid down under Section 438(2) Cr.P.C.
