The petitioners seek anticipatory bail in connection with Arwal P.S. Case No. 105 of 2018 registered under Sections 467, 468, 471, 420 and 120(B) of the Indian Penal Code. The informant Co-operative Extension Officer, Arwal lodged an FIR against one Sanjay Kumar, President PACS Arwal, Block Arwal and some guilty farmers with regard to purchase of paddy after manipulating the khata no. and plot no. of the beneficiaries. It is further alleged that the farmers have shown false area of land and received payment of paddy without supplying the same.

Learned counsel for the petitioners submitted that

Patna High Court Cr.Misc. No.31052 of 2018(2) dt.21-05-2018 2/2 they are quite innocent and have been falsely implicated in this case. It has further been submitted that no irregularity has been committed by the petitioners to sell their paddy through PACCS and they have not prepared any forged and fabricated documents and main accused Sanjay Kumar has already been granted anticipatory bail vide Criminal Misc. No. 13488/2018 dated 06.04.2018 and allegation alleged against these accused petitioners is similar in nature.

Considering the facts and circumstances of the case, prayer of Anticipatory bail is allowed and petitioners named above in the event of arrest or surrender before the court below within four weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal in connection with Arwal P.S. Case No. 105 of 2018 , subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
