Heard learned counsel appearing on behalf of the petitioner, learned counsel for the informant and learned A.P.P. for the State.

Let the defect(s), if any, be removed within two weeks of the complete start of the physical Court in normal course.

The petitioner, who is in custody since 01.01.2016, seeks regular bail in connection with Marhaura P.S. Case No. 148 of 2004 for the offence punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act. The learned Additional District and Sessions Judge-

Patna High Court CR. MISC. No.38695 of 2021(4) dt.21-02-2022 2/2 VII, Saran vide its Letter No. 9 dated 18.01.2022 has reported that the trial has progressed and is at the verge of conclusion. Considering the aforesaid fact as informed by the learned court below, I am not inclined to enlarge the petitioner on bail at this stage.

Accordingly, the present bail application is rejected. The trial court is directed to conclude the trial within a period of six months.

If no substantial progress takes place in the trial within the aforesaid period, the petitioner, if so advised, may renew his prayer for bail.
