The petitioner seeks bail in Antichak P.S. Case No. 02 of 2019, instituted for the offence under Section(s) 419, 420, 384 of Indian Penal Code, Sections 18(c), 18(A), 18B, 27(b)(ii), 28A, 28 and 36(AC) of Drug & Cosmetic Act 1940 revise Act 2008.

In the written report it is alleged that son of the informant Rohit Kumar Gupta was assaulted by petitioner in the market as he demanded his dues from him. Petitioner snatched the Mobile phone of son of the informant and to save his skin, lodged the case against son of the informant under SC/ST Act and demanded money from the informant to compromise the case.

Patna High Court CR. MISC. No.27833 of 2019(4) dt.15-07-2019 2/2 Counsel for the petitioner submits that mere vague and omnibus allegation has been levelled against the petitioner. He further submits that there is no allegation of any specific overt act against the petitioner.

Petitioner is in custody since 17.1.2019.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XIV, Bhagalpur, in connection with Antichak P.S. Case No. 02 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
