2. The petitioner apprehends his arrest in a case registered for the offence under Sections 366A, 34 of the Indian Penal Code and Sections 8, 10 of the POCSO Act.
3. It is alleged that this petitioner alongwith other F.I.R. named co-accused kidnapped the minor daughter of the informant for the purpose of marriage.
4. The victim, in her statement recorded under Section 164 Cr.P.C., has denied the prosecution case and has categorically stated that no one has kidnapped her and she voluntarily left the house out of anger with her mother. Petitioner has been made accused merely because he is brother of co-accused Arun Kumar, with whom the victim was in love. Petitioner claims clean antecedent.

5. Considering the statement of the victim recorded under Section 164 Cr.P.C., the prayer for anticipatory bail of petitioner is allowed. In the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th A.D.J.-cum-Special Judge, POCSO, Motihari, East Champaran in connection with Harsidhi P.S. Case No. 647 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
