JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 18-09-2017 The present petition has been filed for transfer of Divorce Suit No. 44 of 2015 from the Court of learned Principal Judge, Family Court, Vaishali to the Court of learned Principal Judge, Family Court, Madhubani.
2. Learned counsel for the petitioner submits that she is residing with her father at Madhubani and would face difficulty in traveling to Vaishali to contest the above Divorce Suit.
3. Learned counsel for the opposite party no. 2 appears and makes a statement at the Bar that in view of discussions and negotiations between the parties the opposite party no. 2 proposes to file a petition for withdrawal of the subject Divorce Suit, but the same
Patna High Court MJC No.267 of 2016 dt.18-09-2017 would not be proceeded with in view of the interim orders of this Court dated 23.02.2017.
4. Having regard to the stand of the opposite party no. 2, the present petition is being disposed of to enable the opposite party no. 2 to move for withdrawal of the subject Divorce Suit. The opposite party no. 2 undertakes that such petition for withdrawal of the Divorce Suit No. 44 of 2015 shall be filed within two weeks from today. In such event the learned Court shall dispose of the petition for withdrawal without undue delay. In case the opposite party no. 2 fails to file petition for withdrawal of the subject Divorce Suit within the stipulated period of two weeks the petitioner shall be at liberty to request for revival of the present petition.
