Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Shastrinagar P.S. Case No. 414 of 2022 registered on 13.07.2022 lodged under Sections 302/34 of the I.P.C. As per the prosecution case, F.I.R. has been lodged against three named accused persons excluding petitioner. Learned counsel for the petitioner submits that from the content of the F.I.R. it is clear that the there is specific allegation of commission of crime against named accused persons. Counsel submits that the petitioner is not named in the F.I.R. and his name has come in this case on the basis of confessional statement. He further submits that both the accused whose name has come directly and the accused whose name has

No.29204 of 2023(2) dt.07-06-2023 2/2 been inserted by the confessional statement whose case is similarly situated as like that of the present petitioner and bail have been granted by the Co-ordinate Bench of this Court, which is Annexure-2 vide order dated 07.04.2023 in Cr. Misc. 5294 of 2023 and vide order dated 23.05.2023 in Cr. Misc. No.19705 of 2023.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XI, Patna in connection with Shastrinagar P.S. Case No. 414 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
