The petitioner is apprehending arrest in a case registered for the offences punishable under sections 341,324,325,307,120B and 427/34 of the IPC and Section 27 of the Arms Act. The prosecution case as per the fardbeyan of the informant Suresh Paswan is to the effect that on 31.8.2017 at 9 A.M. he was travelling on Highway on a motorcycle when six motorcycle borne miscreants came, of whom the informant could identify only the pillion riders of the respective motorcycles as Dilip Yadav, Jhantu Mandal and Arjun Mandal but he could not identify the drivers of the three motorcycles as they were wearing helmet. In the last portion of the FIR it is alleged that on the instigation of this petitioner and co accused Ranjit Vishwas, the three aforesaid persons resorted to fire causing injury on the back and hand of the informant.

No.59897 of 2017(2) dt.12-12-2017 2/2 It is submitted by learned counsel for the petitioner that from the FIR itself it is manifest that specific accusation of firing has been levelled against three above named accused. Moreover, it is apparent that the petitioner was present at the place of firing. The petitioner is the son of present Panchayat Mukhia, hence the defeated candidate set up the present informant to lodge the case with malicious accusation. It is further submitted that the petitioner has been roped in the present case due to political rivalry. Considering the fact that the accusation of firing is not levelled against the petitioner, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Araria in connection with Forbesganj (Simraha) P.S. Case No. 680 of 2017.
