1. Heard learned counsel for the petitioner, learned A.P.P. for the State, Ms. Gulnar Begum and the learned counsel appearing on behalf of the informant.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 498A, 494 and 34 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner, being husband, has been falsely implicated in the instant case by the informant. It is further submitted that the marriage of the petitioner with the informant was performed in the year 2003 and out of the wedlock, two children were born
Patna High Court CR. MISC. No.28882 of 2025(5) dt.18-08-2025 2/3 who presently are staying with the petitioner. It is also submitted that the informant, on her own volition, left the house and went back to her parental home in the year 2023.
4. The learned counsel appearing on behalf of the informant submits that police after investigation finding the case to be true against the petitioner has submitted charge sheet. It is also submitted that informant was suffering at the hands of the petitioner since the time of marriage and since her children were young as such she could not take any bold decision, but after the children grew up and the torture continued, the informant left her matrimonial home and came back to her parental home in the year 2023 thinking that petitioner will take her back, but when petitioner did not come to take her back then she enquired when it came to her knowledge that petitioner has performed his second marriage.

The learned counsel appearing on behalf of the informant next submits that one can well imagine the plight of the informant who is the first wife of the petitioner that after putting in more than 20 years of marriage, she had to leave the house of the petitioner in an unceremonial manner on account of torture meted out. It is further submitted that now informant realizes that she was being tortured as the petitioner intended to
Patna High Court CR. MISC. No.28882 of 2025(5) dt.18-08-2025 3/3 perform his second marriage. It is also submitted that one can well imagine the plight of the informant that how she is surviving for the last two years in absence of any financial support from the petitioner.
6. Considering the submissions made by the learned counsel appearing on behalf of the informant, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner.
7. Accordingly, the instant anticipatory bail application stands rejected.
