2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 447, 448 , 323 , 307, 354, 379, 427, 506 and 34 of the Indian Penal Code . 3 . As per the prosecution case , on the alleged date and time of occurrence , this petitioner along with other F.I.R. named co-accused persons entered in the house of informant and on the order od co-accused Deepak Kumar Vidyarthi, all the accused persons assaulted informant and her sons due to which they sustained head injury . It is further alleged that other coaccused outraged the modesty of informant and looted household articles.

4. Learned counsel for the petitioner submits that both parties are agnates and there is pending land dispute between them. He further submits that informant's side wanted to encroach the common passage /road of the village , which was being opposed by petitioner's side , due to which scuffle took place between the parties. Case and counter case . Allegation of assault is general and omnibus against this petitioner. Injury sustained by injured is simple in nature . Petitioner claims clean antecedent. Similarly situated co-accused persons have already granted bail by this Court vide order dated 02.08.2024 in Cr. Misc. No. 33197 of 2024 .
5 . Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the fact that similarly situated accused persons have already granted bail, nature of injury , case and counter case , clean antecedent and circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Khagaria in connection with Mansi P .S. case No. 107 of 2023 , subject to the conditions laid
