The petitioner apprehends his arrest in connection with Mithanpura P.S. Case No. 95 of 2017, registered under Sections 302 and 120B/34 of the Indian Penal Code and 27 of the Arms Act.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R., but in course of investigation, one Ranjit Kumar gave his confessional statement showing the name of petitioner and one Kundan Kumar having hand in the present case, except that there is nothing against him. It is further submitted that similarly situated co-accused, Kundan Kumar, has already been granted privilege of bail by this Court vide order dated 22.09.2017 passed in Criminal Misc. No. 46537 of 2017.

No.51847 of 2017 (2) dt.06-11-2017 Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, East Muzaffarpur, in connection with Mithanpura P.S. Case No. 95 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
