The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 452, 450, 440, 427, 120, 120 A & 307 of the Indian Penal Code, Section 3 of the Explosive Substance Act and Section 17 of the Criminal Amendment Act.
Some unknown miscreants have blown up the newly constructed building of Gobardhana Police Station by triggering serial blast and left the MCC literature on the spot. Learned counsel for the petitioner submitted that no such occurrence as alleged ever took place. The petitioner is quite innocent and has been falsely implicated in this case due
Patna High Court CR. MISC. No.27753 of 2019(3) dt.01-08-2019 2/2 to dirty village politics. There is no eye witness of the occurrence. There is nothing cogent on record indicating the complicity of the petitioner in the occurrence. Though one more criminal case has been lodged against the petitioner but he is on bail in the said case.
Learned APP for the State opposed the bail petition.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1stAdditional Sessions Judge, Bagaha in connection with Gobardhana P.S. Case No. 14 of 2003, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
