JUSTICE RAKESH KUMAR ORAL ORDER 10-11-2016 Heard Sri Surya Prakash Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner has approached this Court for grant of bail, in the event of his arrest or surrender, in Spl. Case No.59 of 2016, corresponding to Sultanganj P.S. Case No.166/16, registered for the offence under Sections 20/22 of Narcotic Drugs and Psychotropic Substance Act.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case since the land, from which Ganja was recovered, was disputed and this fact has been noticed in the F.I.R. itself. He submits that the petitioner was favouring one Anil Yadav, who was claiming the land and this was the reason that a false case was instituted against the
Patna High Court Cr.Misc. No.47466 of 2016 (2) dt.10-11-2016 2/2 petitioner, whereas from perusal of the material on record, it is evident that there is material to suggest that the petitioner was involved in the offence, in which more than 17 Kg of Ganja was recovered.
I do not find any ground to extend the privilege of anticipatory bail. The petition stands dismissed. (Rakesh Kumar, J) NKS/- U T
