1. Heard learned counsel for the petitioner, learned AC to SC-9 for the State and the learned counsel appearing on behalf of the NHAI.
2. The learned counsel appearing on behalf of the NHAI, at the outset, submits that petitioner has rushed to this Court without availing her alternative remedy before the Commissioner-cum-Arbitrator in terms of Section 3G(5) of the National Highways Act, 1956.
3. The learned counsel for the petitioner, after some arguments realizing his difficulty, seeks permission to withdraw
Patna High Court CWJC No.7534 of 2025(2) dt.26-06-2025 2/2 the writ application with liberty to move before the authority competent in terms of Section 3G(5) of the National Highways Act, 1956.
4. Permission is accorded.
5. It is made clear that in the event if any issue of limitation arises, the authority competent shall keep in mind that petitioner was pursuing her remedy before this Court since 05.05.2025.
