The petitioner is apprehending his arrest in connection with Dumraon P.S. Case No. 123 of 2018, registered for offences punishable under Section 30(A)/ 41 (1) of Bihar Excise Act.
The prosecution case in short is that total 57900 liters wine is said to have been recovered.
Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and the similarly situated co-accused persons have been granted privilege of anticipatory bail vide order dated 14.05.2018 passed in Cr.
Patna High Court Cr.Misc. No.31294 of 2018 (2) dt.24-05-2018 2/2 Misc. No.29860/2018 and vide order dated 16.05.2018 passed in Cr. Misc. No.30316/2018.
Considering the aforesaid facts that the similarly situated co-accused have been granted privilege of bail, let the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) each with two sureties of the like amount each in connection with Dumraon P.S. Case No123 of 2018 to the satisfaction of learned Additional District Judge-2nd -cum- Special Judge, Excise Act, Buxar, subject to the condition laid down under Section 438 (2) of the Criminal Procedure Code.
