The petitioner apprehends his arrest in connection with Chhauradano P.S. Case no. 44 of 2018, registered under Section 7 of E.C. Act.
The accusation is that on receiving secret information about black marketing of the kerosene oil by fair price shop dealers, namely, Dina Nath Sah, Nawal Rai, Meghu Yadav and Din Dayal Prasad, the Block Supply Officer, Chhauradano inspected the kerosene oil shop of the aforesaid dealers and seized kerosene oil kept in different containers from different places. In course of inquiry, it has also come that petitioner, who is brother of Dina Nath Sah, used to help in
Patna High Court Cr.Misc. No.29213 of 2018(2) dt.10-05-2018 2/2 illegal black marketing of kerosene oil of Dina Nath Sah. Learned counsel for the petitioner submits that, in fact, the petitioner is the brother of Dina Nath Sah, who is licence hold of fair price shop, the petitioner has no concerned about his business, but being the brother of Dina Nath Sah, he has also been implicated in this case without any cogent material. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Raxaul at Motihari in connection with Chhauradano P.S. Case No. 44 of 2018, subject to the condition as laid down under Section 438
(2) of the Cr.P.C.
