Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Morhowrah P.S. Case No. 143 of 2023 registered for the offence under Sections 20/22 N.D.P.S. Act.

As per the F.I.R., there is recovery of 4K.G. of Ganja from the house of the petitioner which is of intermittent quantity and the petitioner is in custody since 17.03.2023. Learned counsel for the petitioner submits that the petitioner is in custody since 17.03.2023 and the petitioner is quite innocent and has not committed any offence. Learned A.P.P. has vehemently opposed the prayer

Considering the aforesaid facts and the recovery of intermittent quantity of ganja and considering the clean antecedent of the petitioner, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet or after completing six months in custody whichever is later and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge, Saran at Chapra/concerned Court below in connection with Morhowrah P.S. Case No. 143 of 2023.
