The petitioner seeks bail in Kudhani P.S. Case No.421 of 2018 registered under Sections 414 and 34 of the Indian Penal Code and under Section 30(a) of Bihar Prohibition and Excise Act.

The police intercepted the Wagonr vehicle and arrested Bhola Kumar, the driver of the vehicle. On search 35.280 litres of foreign liquor was recovered from the vehicle. Bhola Kumar disclosed the name of the petitioner(Anil Sahani), Rakesh Sahani, Raj Kumar and Dev Kumar as his associates. The learned counsel for the petitioner submits that petitioner is in jail since 05.06.2020. Nothing has been recovered from the possession of the petitioner. The name of the petitioner surfaced in the case in the confessional statement of

Patna High Court CR. MISC. No.25043 of 2020(2) dt.21-09-2020 2/2 Bhola Kumar from whose possession 35.280 litres of Indian made foreign liquor was recovered. Other accused persons have already been granted bail.

Taking into consideration the facts aforesaid, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur in connection with Kudhani P.S. Case No.421 of 2018.
