The petitioner seeks bail in anticipation of his arrest in connection with Dehri Nagar (Indrapuri O.P.) P. S. Case No. 470 of 2019 dated 13.07.2019, instituted for the offences under Sections 406, 409, 420 and 34 of the Indian Penal Code.

The petitioner in his capacity as Vikas Mitra is said to have defalcated government money which was meant for the beneficiaries of Indira Awas Scheme. It has been submitted on behalf of the petitioner that on vague and frivolous grounds, the

Patna High Court CR. MISC. No.28228 of 2020(3) dt.06-01-2021 2/3 petitioner is sought to be prosecuted in the present case. The petitioner in his capacity as Vikas Mitra had no role to play in the transfer of funds to the beneficiaries.

Regard being had to the nature of accusation, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sri Vivek Kumar Singh, J.M. 1st Class, Dehri (Rohtas), in connection with Dehri Nagar (Indrapuri O.P.) P. S. Case No. 470 of 2019, subject to the conditions as laid down under Section 438

(2) Cr.P.C.

However, it is made clear that the petitioner shall participate in the investigation and shall render all assistance to the Investigating Officer. In case the

No.28228 of 2020(3) dt.06-01-2021 3/3 petitioner is found to be reluctant in parting necessary information to the Investigator, the matter could be brought to the notice of the court below and the Investigator shall be at liberty to proceed for cancellation of anticipatory bail of the petitioner.

The petition stands disposed off with the aforesaid observation.
