The petitioners seek pre-arrest bail in connection with Chainpur P.S. Case No.257 of 2017 registered under Sections 341, 323, 307 and 504/34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioners that there is general and omnibus allegation against all the accused persons. It would be manifest from perusal of the FIR itself that occurrence took place on sudden provocation and no lethal weapon was used in the occurrence. The injured persons sustained simple and superficial injuries.

Learned counsel for the State has opposed the prayer for

Patna High Court Cr.Misc. No.58737 of 2017 (2) dt.13-12-2017 2/2 grant of pre-arrest bail to the petitioner.

Considering the facts and circumstances of the case and the submissions made above, in the event of arrest or surrender before the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each ith two sureties of the like amount each to the satisfaction of learned A.C.J.M., Kaimur at Bhabua in connection with Chainpur P.S. Case No.257 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
