The petitioner seeks bail in Kateya P. S. Case No. 50 of 2019 instituted for the offence under Section(s) 376 and 511 of the Indian Penal Code.

Learned counsel for petitioner submits that there is case and counter case between the parties.

In the written report it is alleged that on the date of occurrence petitioner attempted to commit illegal act with daughter of the informant after pressing her mouth. Learned counsel further submits that petitioner has been implicated in this case due to previous enmity and local politics . It has further been submitted that counter case has been filed by the wife of petitioner against the present informant and others vide Kateya

Patna High Court CR. MISC. No.26548 of 2019(2) dt.24-04-2019 2/2 P.S. case no. 57 of 2019 alleging that present informant and other accused persons have assaulted the petitioner. Petitioner is in custody since 8.2.2019 having clean antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM -XV,Gopalganj , in connection with Kateya P. S. Case No. 50 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner.
