2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 126(2), 115(2), 352, 351(2) read with section 3(5) of the B.N.S. 2023. 3 . As per F.I.R. informant alleged that on 09.01.2026 all the accused persons including these petitioners armed variously came and petitioner no. 1 assaulted on the head of informant by means of iron rod, as a result of which he

Patna High Court CR. MISC. No.30080 of 2026(2) dt.11-05-2026 2/3 sustained injury. It is further alleged that petitioner no. 2 assaulted on the head of informant by means of Khanti. It is further alleged that other accused assaulted informant by means of lathi.

4. It is submitted on behalf of the petitioners that allegation of assault against petitioner nos. 2, 3, 4 and 5 is general and omnibus. Case and counter case. Petitioners claim clean antecedent.

5 . Learned counsel for the State opposed the bail petition and submitted that injury caused by petitioner no. 1 is grievous in nature.

6. Considering the nature of accusation, injury and other circumstances of the case, prayer for pre-arrest bail of petitioner no. 1 is rejected.

7. Considering the general and omnibus allegation of assault against petitioner nos. 2, 3, 4 and 5, clean antecedent of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner nos. 2, 3, 4 and 5, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-5, Kaimur, Bhabua in connection with
