JUSTICE SANJAY PRIYA ORAL ORDER 09-07-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Bathnaha P.S. Case No. 241 of 2017 instituted for the offence under Sections 384,385 of the IPC.
It is alleged in the written report that demand of ransom of Rs. 5,00,000/- was made on mobile phone of the informant from sim no. 7739225935 and threat was given to kill him if ransom amount is not paid.
Learned counsel for the petitioner submits that case diary has been received.
Learned APP for the State submits that it is mentioned in paragraph 24 of the case diary that owner of sim no. 7739225935 was one Sitaram Paswan. The aforesaid sim was used by petitioner.

No.30384 of 2018(3) dt.09-07-2018 2/3 been falsely implicated in this case because the petitioner and villagers caught one pick-up van loaded with P.D.S. rice which was going to market for black marketing. The same was handed over to the Block Supply Officer, Bathnaha who registered Bathnaha P.S. Case No. 239 of 2017 under Section 420 of the IPC and Section 7 of the E.C.Act and due to that annoyance the informant has lodged this case against the petitioner. In such circumstances, prayer for anticipatory bail is allowed and it is ordered that the petitioners, named above, in the event of their arrest or surrender in the court below within six weeks from the date of receipt/production of copy of this order, shall be released on bail on furnishing bail bonds of Rs.
10,000/- (ten thousand) each with two sureties of the like amount each in connection with Bathnaha P.S. Case No. 241 of 2017 to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, subject to condition as laid down u/S 438 (2) of the Cr. P.C.
Patna High Court Cr.Misc. No.30384 of 2018(3) dt.09-07-2018 3/3 reasonable reason, will automatically cancel bail bonds of the petitioner and (3) if the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
