The petitioner apprehends his arrest in connection with Complaint Case No.974 of 2018 (Trial No.1746 of 2021), filed for the offences punishable under Sections 498A of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. The petitioner, who is mother-in-law of the complainant, is said to have tortured the complainant mentally and physically for non-fulfillment of demand of additional dowry.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the

Patna High Court CR. MISC. No.37827 of 2021(3) dt.28-06-2022 2/2 present case. It is further submitted that there is general and omnibus allegation against the petitioner. It is submitted that the petitioner is mother-in-law of the complainant and she has no manner of concern with the family affairs of her son and daughter-in-law.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Taking into consideration the facts aforesaid, let petitioner, above named, in the event of her arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sadar at Motihari in connection with Complaint Case No.974 of 2018 (Trial No.1746 of 2021), subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
