The petitioners apprehend their arrest in connection with Khanpur P.S. Case no. 57of 2016, registered under Section 304(B) and 34 of the Indian Penal Code.

The accusation is of killing of daughter of the informant by her husband and other in-laws of the deceased due to nonfulfillment of demand of dowry. Learned counsel for the petitioners submits that petitioners, being the father-in-law and mother-in-law of the deceased, have falsely been implicated in this case. Further submission is that, in fact, deceased daughter of the informant died due to illness and information regarding the occurrence was also given to the informant, who participated in the funeral ceremony, but only to give pressure,

Patna High Court Cr.Misc. No.44288 of 2016 (2) dt.22-10-2016 2/2 this false case has been lodged. Further submission is that it would appear from the F.I.R. that the marriage of deceased was performed with Mithun Kumar in the year 2008 and the occurrence took place on 27.05.2016 after about 07 years and 10 months as such offence under Section 304(B) of the I.P.C. is not attracted. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-IIIrd, Samastipur in connection with Khanpur P.S. Case No.57 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
