Petitioners apprehend arrest in connection with Shahkund (Sajour) P.S. Case No. 8 of 2019 registered for the offence punishable under sections 379,385/34 of the Indian Penal Code, Section 40 of the Bihar Minor Mineral Concession Rules and Sections 6/8 of the Illegal Mining Transportation and Storage Rules, 2003.
Learned counsel appearing for the petitioners submits that petitioners are the owner and driver of the tractor in question and they have been falsely implicated in the present case merely on suspicion. As a matter of fact, at
Patna High Court CR. MISC. No.26916 of 2019(2) dt.24-04-2019 2/2 the time of seizure, nothing was loaded in the tractor. During investigation also, nothing has come against these petitioners. Petitioners are men of clean antecedent. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Shahkund (Sajour) P.S. CaseNo. 8 of 2019 subject to the conditions laid down under section 438(2) Cr.P.C.
