====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-10-2020 Heard Mr. Rajani Kant Pandey, learned Advocate for the petitioners and the learned APP for the State.

The petitioners seek bail in anticipation of their arrest in connection with Chainpur P.S. Case No. 84 of 2020 dated 10.03.2020 instituted for the offences under Sections 341, 323, 379, 307, 386, 504, 506 and 34 of the Indian Penal Code and Section 37(i)(ii) of the Bihar Prohibition and Excise Amendment Act, 2018. The informant and his brother were waylaid by two persons who have been named in the FIR for the purposes of extracting money from them for bringing liquor. When that was refused, the informant and his associate were assaulted. Later the petitioners are

Patna High Court CR. MISC. No.25680 of 2020(2) dt.13-10-2020 2/2 alleged to have threatened the informant and also demanded Rs. 5000/-.

Learned counsel for the petitioners submits that the allegations do not make out any sense and there is a counter version of the occurrence also. There was some dispute between the parties and because of such dispute two sets of cases have been filed by the parties. Now on the good sense having prevailed upon the members of both the parties, the matter has been compounded.

Considering the nature of accusations against the petitioners and whole background of the case, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-V-cum-Special Judge Excise, Kaimur at Bhabua in connection with Chainpur P.S. Case No. 84 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
