Petitioner, daughter-in-law of the deceased, is an accused in a case registered for the offence punishable under Sections 324,326,307,302/120B of the Indian Penal Code on the allegation that she, by forming a conspiracy, got informant's father killed at the hands of her relatives by assaulting him with knife, who died on way to the hospital.

Learned counsel for the petitioner submits that from perusal of the FIR it is evident that the informant is the eye witness and being so he has named the accused persons hurling fatal assault on informant's father and the petitioner has only been said to have hatched out the conspiracy behind the occurrence. Learned counsel further submits that the petitioner has been implicated in this case on suspicion due to pending

Patna High Court CR. MISC. No.30722 of 2019(4) dt.18-09-2019 2/2 family disputes/cases. He submits that nothing incriminating has come in course of investigation to connect the petitioner with the occurrence. Petitioner has got no criminal antecedent and she is in custody since 27.11.2018.

Learned counsel for the informant vehemently opposes the prayer for bail.

In view of the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in Banka Police Station Case No. 790 of 2018 on the condition that the petitioner shall fully co-operate with the investigation and trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
