The petitioner is apprehending his arrest in connection with Warsaliganj P.S.Case No.314 of 2018 dated 3.9.2018 , registered for offences punishable under Sections 341, 323, 504, 307, 326, 379/34 of the Indian Penal Code. Allegation as per FIR against the petitioner and other accused persons is that they tried to damage the paddy in the field of the informant and when the informant went their house to make complaints, the petitioner called his two sons and asked them to kill him; on which his both sons assaulted him by sword and 'Fasuli' causing injury to him. Submission of the learned counsel for the petitioner is that there is land dispute between the parties and there is case
Patna High Court CR. MISC. No.26942 of 2019(2) dt.25-04-2019 2/2 and counter case between the parties and there is no allegation of assault against the petitioner.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM 2nd, Nawada in connection with Warisaliganj P.S.Case No.314 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid direction, this application is allowed.
