Petitioner is apprehending his arrest in connection with Mahila P.S.Case No.33 of 2018 registered for offences punishable under Sections 498(A), 34 of the Indian Penal Code. Allegation against the petitioner is of torturing his wifeO.P.no.2 and assaulted her with respect to demand of the motorcycle. It has also been alleged that he has re-married with another lady.
Submission of the learned counsel for the petitioner is that the allegation is false and concocted and he has stated on oath that he has not re-married with another lady and he is still ready to keep her with dignity and care .
Heard learned A.P.P. and the learned counsel for the
Patna High Court CR. MISC. No.25898 of 2019(4) dt.03-07-2019 2/2 O.P.no.2, who has submitted that she is also ready to reside with the petitioner if she is allowed to live with dignity and care. . Having heard both sides and considering the stands of the parties, let the petitioner appear before the learned court below on 11.7.2019 and on that day O.P.no.2 shall also remain present in the court and on filing an affidavit by the petitioner that he is ready to keep her and to take her from the court itself, the provisional bail granted to the petitioner shall be extended for a period of six months with condition that both the parties have to appear before the court in the first week of each month and once being satisfied with the marital relationship between the parties and the conduct of both the parties, especially the conduct of the petitioner, he will consider the prayer for confirmation of the bail bond of the petitioner, otherwise he is free to pass any other order or orders as he deems fit and proper.
With the aforesaid direction, this application is disposed of.
