Heard learned counsel for the petitioners as well as the Mr. Md. Mushtaque Alam, learned APP for the State. The petitioners apprehend their arrest in connection with Complaint Case No. 584 of 2021, registered for the offences punishable under Sections 323/406/420/494/498A/120(B) of the Indian Penal Code and 3/4 of Dowry Prohibition Act, 69 of D.I.T. Act.
As per allegation, the marriage of complainant was solemnized with co-accused Anurag Kumar. The matrimonial
Patna High Court CR. MISC. No.29198 of 2022(2) dt.07-09-2022 2/3 inmates demanded rupees eight lakhs cash and ornaments and due to non-fulfillment of demand she was tortured. There is allegation against the petitioners that they asked the complainant that they would solemnize another marriage of her husband as prior to occurrence the husband has solemnized three marriages and one of the bride was killed by burning.
Learned counsel for the petitioners has submitted that there is allegation against the petitioners that they tortured the complainant for non-fulfillment of demand of dowry. The learned counsel for the petitioners has submitted that they are innocent and have falsely been implicated in this case. They are father-in-law and mother-in-law of the complainant having no concern with day to day affairs of the couple. On the other hand, the learned Addl. P.P. has opposed the prayer for bail.
Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Surbhit Sahai, Judicial Magistrate, 2nd Class, Barh in connection with Complaint Case
Patna High Court CR. MISC. No.29198 of 2022(2) dt.07-09-2022 3/3 No. 584 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C.
Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
