JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 22-11-2022 Heard learned counsel for the petitioner, learned counsel for the Respondent No.2 and learned APP for the State. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with CBI/ACB 2015 R.C. 02320 15(A) 0013 arising out of GRP Patna P.S. Case no. 245 of 2001 instituted for the offence under Sections 380, 120B of the Indian Penal Code. The prosecution case in brief as alleged that when the consignment of postal goods reached at Patna Railway Station, the concerned officers of railway in the presence of officers of RPF handed over the above items by Open Delivery but these were fount to be damaged. It is further alleged that the petitioner had used five stolen fake NSC of denomination of Rs. 1000/-and out of used five stolen NSCs, two original stolen NSCs are available and during investigation it has been disclosed that these NSCs were not issued by GPO Patna and bear fake stamp and signature.
Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. The allegation leveled against the petitioner is false and fabricated. It is further submitted that the petitioner is just a Govt. servant and the alleged NSCs for Rs. 5000/- was purchased through Postal Agent at G.P.O., Patna in usual course and the challan for the purchase of these NSCs was filled by the postal agent in this own hand writing which is mentioned in para 8 of the petition.
Learned APP appearing for the state and learned counsel for the Respondent No.2 have opposed the prayer of anticipatory bail.
Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner

Case No. 245 of 2001, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, CBI, Patna subject to the conditions as laid down under section 438(2) of the Cr.P.C.
