JUSTICE ALOK KUMAR SINHA ORAL ORDER 12-05-2025 Heard Mr. Kaushalesh Choudhary, learned counsel for the petitioner and Mr. Majid Mahboob Khan, learned AC to AAG-12 for the Respondent-State.

2. With the consent of both the parties, this writ application is being disposed of at the present stage.

3. For the reliefs claimed by the petitioner in the present writ application, the learned counsel for the petitioner submits that the petitioner has filed a representation before the District Magistrate, Darbhanga vide Annexure-P/3 which is

4. Learned counsel for the petitioner submits that he would be satisfied if an appropriate direction is given to the District Magistrate, Darbhanga to dispose of the said representation within a fixed time after giving an opportunity of hearing to the petitioner.

5. The learned counsel appearing for the RespondentState has no objection to this prayer being made by the learned counsel for the petitioner.

In view of the above, this writ application is disposed of with a direction to the District Magistrate, Darbhanga (respondent no. 2) to decide the representation dated 02.04.2025 (Annexure-P/3) within two months from the date of production of a copy of this order. While deciding the representation of the petitioner, the petitioner shall be given sufficient opportunity to defend himself and a final order passed by the District Magistrate, Darbhanga shall be a reasoned and speaking order.

7. It is considered appropriate to observe that the District Magistrate, Darbhanga shall ensure that the construction of Panchayat Sarkar Bhawan in Village-Horalpatti, DistrictDarbhanga is being done strictly in accordance with the

Patna High Court CWJC No.6816 of 2025(2) dt.12-05-2025 3/3 guidelines given by the State Government on 30.08.2022 (Annexure-P/4) and particularly Clause-2(V) is being strictly adhered to. No construction should be permitted to be done in violation of the guidelines.

8. With the above observation and direction, the writ application is being disposed of.
