====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 10-11-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Special Case No. 02 of 2019 arising out of RC Case No. 9(A) of 2018 for the offence under Sections 409, 420, 468, 471 and 120B of the Indian Penal Code and Section 13(2) read with Section 13(1)(C) and (D) of the P.C. Act.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, the co-accused having more or less similar allegation has already been granted regular bail by a co-ordinate Bench of this Court in Cr. Misc. No. 40816 of 2019 and the case of this petitioner stands on similar footing. The petitioner is rotting in judicial custody since 28.01.2019. Hence, the petitioner may be

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 50,000/- (fifty thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, CBIII, Patna in connection with Special Case No. 02 of 2019 arising out of RC Case No. 9(A) of 2018, subject to the conditions; (a) The petitioner shall fully cooperate with the trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner.

(b) Both the bailors shall be resident of territorial jurisdiction of the learned court below having immovable property within the jurisdiction of the learned court below. (c) The petitioner shall not leave the country without permission of the learned Trial Judge.

(d) The petitioner shall not indulge in tampering the evidence.
