2. Heard learned counsel for the petitioner and learned A.P.P. for the State.

3. The petitioner seeks regular bail in connection with Bhargama P.S. Case No. 96 of 2021 dated 22.06.2021, lodged under Section 392 of the Indian Penal Code but charge sheet has been submitted under Sections 392, 397, 411 of the Indian Penal Code.

4. As per prosecution case, the F.I.R. has been lodged against three unknown accused persons against whom the allegation of robbery of motorcycle and loot of Rs.1,20,700/- (Rupees One Lac Twenty Thousands and Seven Hundred) are there.

5. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 17.12.2022, charge

Patna High Court CR. MISC. No.29423 of 2023(2) dt.08-06-2023 2/2 sheet has already been filed and there are two criminal cases pending against him in which he is persuading for bail. He further submits that name of petitioner has been figured in this case by virtue of confessional statement. He also submits that the other co-accused has been granted by the Co-ordinate Bench of this Court vide order dated 23.05.2023 passed in Cr. Misc. No.25535 of 2023.

6. Learned counsel for the State opposes the prayer for bail.

7. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Araria in connection with Bhargama P.S. Case No. 96 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C..

8. With this observation, the bail application stands allowed.
