====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 10-02-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with Kashichak P.S. Case No. 85 of 2014 for offence registered under section 420 of the Indian Penal Code.

Allegation against the petitioner is that while the complainant was making an attempt to withdraw the money from A.T.M., one stranger walking nearby helped her in withdrawing the money and he withdrew Rs. 25,000/- in total and thereafter fled away with the money.

From investigation it transpired that one co-villager identified this petitioner. In para-3 of the anticipatory bail petition it is stated that this petitioner has clean antecedent. However,

Patna High Court Cr.Misc. No.48369 of 2016 (3) dt.10-02-2017 para-45 of the case diary shows that this petitioner has criminal antecedent.

So due to suppression of this fact, the prayer for grant of anticipatory bail to the petitioner, is rejected. However, the petitioner may seek regular bail before the court below which shall be considered and disposed on merit without being prejudiced by this order.
