18-10-2017 Heard Sri Sanjay Kumar @ S.K., learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in connection with Hathauri P.S. Case No. 61 of 2017 registered for offence under Sections 272, 273, 290 of the Indian Penal Code and Section 30(A) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender.
It was submitted by learned counsel for the petitioner that no recovery was effected from conscious possession of the petitioner, rather in the present case, recovery of one liter Indian make foreign liquor and 3 liters of country-made liquor was shown from the house of co-accused Dashrath Sahni and only on secret information, petitioner has been named as accused.

Considering the facts and circumstances, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Vinay Kumar Nishad be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Hathauri P.S.
