2. The petitioner seeks bail, who is in custody since 18.01.2026 in connection with Chandauti P.S. Case No. 485 of 2024, F.I.R. dated 21.12.2024 registered for the offence punishable under Sections 319(2), 318(4), 338, 336(3), 340(2), 3(5) of the B.N.S.
3. Allegation against the petitioner is that his original name is Ram Chandra Ram he sold land of father of informant personating him only son of her father by name Sidheshwar Bind.
4. Learned counsel appearing for the petitioner submits that the petitioner has clean antecedent. As per
Patna High Court CR. MISC. No.29685 of 2026(2) dt.04-05-2026 2/3 allegation in the F.I.R., the petitioner claimed that he is son of the land owner, namely, Late Etbar Beldar and he has sold the land in favour of one Pinky Devi. Learned counsel for the petitioner submits that the allegation as alleged in the FIR is false and fabricated. In fact for the same set of allegation, the informant has filed a Title Suit No. 940 of 2024 before the competent Court of law i.e. learned Sub-Judge I Gaya and for the same set of allegation, she has also filed a criminal case only to harass the petitioner in the present case and petitioner is 85 years old person and he has no concern at all with the present occurrence and the petitioner is in custody since 18.01.2026.
5. Learned counsel for the informant and learned APP for the State have opposed the prayer for bail of the petitioner.

Considering the aforesaid facts, petitioner has clean antecedent and the informant has filed a Title Suit for the same set of allegation which is pending for consideration before the competent Court of law, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions JudgeXIth Gaya Ji, in connection with Chandauti P.S. Case No. 485 of 2024,with the following conditions:-

No.29685 of 2026(2) dt.04-05-2026 3/3 (I) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on his/her absence on two consecutive dates without sufficient reason, his/her bail bond shall be cancelled by the Court below. (II) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
(III) And, further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage, it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
